The Demise of the 28-Article Peace Proposal for Ukraine: Why Peace Negotiations Continue to Stumble

Europe experienced widespread relief on Monday, as the diplomatic emergency sparked by the presentation of a new 28-point plan for ending the war appeared – temporarily – to have been stabilised. A Washington representative spoke of "significant advancement" after bilateral negotiations in Geneva. On Monday night, Moscow made its response: an extensive attack of aerial bombardment on Kyiv.

The Rhythm of Negotiation and Warfare

The succession of conflicting incidents captured the grim essence of the current period. By day, diplomatic battles are waged: positive announcements are released from multiple capitals. Considerable effort is expended on restraining certain initiatives. By night, the Kremlin forcefully demonstrates the world that, for them, war remains the key method for achieving "settlement".

After-Dark Attacks

As military strikes developed into the early hours of Tuesday, the immediate reality of Ukraine's vulnerability was revealed. Ukraine is able to track rocket firings from across the border, a capability afforded by up-to-date information. From witness perspectives, defense planes that had been scrambled to counter approaching aerial threats flew past – advanced fighter aircraft provided to Ukraine by NATO members.

Soon thereafter, Kyiv's anti-aircraft weapons engaged: several firings fired to intercept a hostile projectile. This was a advanced protection mechanism at work, presumably delivered by partner states. Every firing shakes the surroundings, causing tremors. The brief panic quickly transforms into resigned acknowledgment: perhaps the hostile projectile won't cause damage this time, protecting urban areas from devastation and further power outages.

Persistent Threats

Soon after, a large-caliber weapon engaged a drone close by, part of a mobile-fire group – almost certainly Western-made equipment. Sadly, the shots failed to hit the hostile drone – it maintained course toward its destination.

Periodically, this carried on until dawn. Kyiv greeted the morning news: multiple fatalities, damage and utility failures in multiple buildings as a result of the night's assault. As typically, everyone still maintained normal activities – experiencing conflict. But those entire period demonstrated Ukraine's critical military reliance on external assistance – a reliance that European nations are evidently unprepared to replace in the near term.

Unsuccessful Negotiations

The 28-point plan from Washington generated strong feelings, discussion and serious worry – and momentarily shifted focus from Ukraine's most significant graft case in years. Yet, we have seen this script before, after earlier high-level meetings and multilateral gatherings.

Every new proposal from US leadership adheres to the same pattern: a diplomatic cavalry charge against Ukraine, which Kyiv, with other European capitals, succeeds in resisting. They contain the crisis but never actually win the battle. This trend will, undoubtedly, endure.

Political Considerations

It is tempting to accuse particular leaders of consistently pushing Kremlin's demands. But that does not seem to be the complete picture. Washington functions according to a assumption understood by experienced diplomats: you cannot win at the negotiating table what you have been unable to protect through force. The American government assumes that it is unfeasible to compel Moscow to surrender the territory that it already controls in Ukraine's southern or eastern regions.

The issue is that while acknowledging this situation, US leadership does little to deter Moscow, through words or deeds, from assuming that the current condition will not shift further in its advantage in the months ahead.

Divergent Views

Therefore, the Kremlin is certain that time is on his side – that Ukraine and its supporters are approaching exhaustion. Their incentive to sign a deal that does not give them the maximum possible gain is virtually nonexistent. There may be many attempts to stop fighting, but they will carry on as long as Russia's leadership remains supremely confident in the result.

On the contrary, Kyiv believes that Ukraine can still hold out, gradually sacrificing civilians and areas but avoiding a entire defensive failure until circumstances change in its favour.

Current Realities

Objectively, there are no actual prerequisites for a truce. Now, personal considerations are coming into play: personal goals to negotiate peace and obtain worldwide acknowledgment, and the government's twin challenges – on one hand, not to distance important partners, and on the other, to mobilize citizens around the country's interests against any plan Kyiv finds unworkable, so that their focus does not shift toward homefront challenges. And although their objective will now be much harder after latest incidents, it remains quite doubtful that this will change their overall approach.

These opposing factors are guiding negotiations.

Assessment and Future

It took a just a single week to kill the suggested clauses of the most recent proposal. Forceful and unpredictable management of the matter by American leadership, pushback by Ukraine and the rest of Europe, along with pacifying measures of representatives, and finally, latest revelations, all did their job.

While new proposals based on established approaches are forthcoming, Kyiv, London and other allied nations should reach an essential realization: Ukraine and Europe will only be able to resist negotiation assaults from Washington that are rooted in Kremlin requirements and demonstrate particular unwillingness to change the course of events, if they stand together and improve their protective measures at a much faster pace. If they do, no combination of diplomatic or military actions will be able to defeat them. In the meantime, Ukraine's ability to defend against evening bombardments will, for the coming months, largely rely on continued Western support.
